By accessing or using the FretGenius application on any platform (iOS, Android, Web) (the "Service"), provided by FretGenius ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
FretGenius is a fretboard learning application designed to help musicians master notes, scales, and theory for various string instruments (including guitar, bass, ukulele, mandolin, banjo) through interactive visualization, quizzes, and customization features. The Service is available on mobile and web platforms. Features include note recognition quizzes, dynamic scale visualization, extensive fretboard customization (instrument type, tuning, visual appearance, left/right-handed orientation, realistic fret spacing), and accurate music notation display.
Currently, the use of FretGenius does not require you to create a user account.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Service on devices you own or control, solely for your personal, non-commercial educational purposes.

The Service, including its visual interfaces, graphics, design, compilation, information, data, computer code (including source code or object code), products, software, features (like the specific implementation of the note quiz, scale visualizer, realistic fret spacing calculations), sounds, and all other elements of the Service ("Materials") are protected by intellectual property and other laws. All Materials contained in the Service are the property of FretGenius or our third-party licensors. Except as expressly authorized by us in these Terms, you may not make use of the Materials. We reserve all rights to the Materials not granted expressly in these Terms.
We use Sentry for crash and error reporting as described in our Privacy Policy. Your use of the Service constitutes acknowledgment of this use. Sentry's service is governed by its own terms and privacy policy.
We reserve the right to modify or discontinue the Service (or any part thereof) at any time, temporarily or permanently, with or without notice. We may also introduce new features, some of which may require payment (e.g., premium upgrades or subscriptions) in the future. Any such paid features will be subject to additional terms and payment obligations presented to you at that time.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WHILE WE STRIVE FOR ACCURACY IN MUSIC THEORY REPRESENTATION AND VISUALIZATION, WE DO NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, COMPLETE, RELIABLE, CURRENT, ERROR-FREE, OR UNINTERRUPTED. WE DO NOT GUARANTEE THAT USING THE SERVICE WILL RESULT IN MASTERY OF ANY INSTRUMENT OR MUSICAL CONCEPT. YOU USE THE SERVICE AT YOUR OWN RISK.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FretGenius, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (a) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE (INCLUDING SENTRY); (c) ANY CONTENT OBTAINED FROM THE SERVICE; OR (d) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT (WHICH, UNDER CURRENT OPERATION, IS LIMITED TO CRASH REPORTS VIA SENTRY).
IN NO EVENT SHALL THE AGGREGATE LIABILITY OF FretGenius EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100.00) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICE GIVING RISE TO THE CLAIM.
You agree to defend, indemnify, and hold harmless FretGenius and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, or your violation of these Terms.
We reserve the right to modify these Terms at any time. If we make changes, we will provide notice of such changes, such as by posting the revised Terms within the Service or updating the "Effective Date" above. Your continued use of the Service after the revised Terms have become effective indicates that you have read, understood, and agreed to the current version of the Terms.
We may terminate or suspend your license to access or use the Service at any time, for any reason or no reason, including for breaching these Terms. You may terminate these Terms at any time by ceasing to use the Service and uninstalling the application. Upon termination, your license to use the Service will immediately cease. Sections 5, 6, 9, 10, 11, 12, 15, and any other provisions which by their nature should survive termination shall survive termination.
